Trading Terms & Conditions

These Trading Terms & Conditions govern all orders, deliveries, and services provided by Mesmerize Lighting.

By ordering, paying for, or accepting delivery of any Mesmerize Lighting products (“Products”), you agree to these terms, whether or not a signed agreement exists.

Accounts & Orders

  • All customers must have an approved trading account.
  • Orders must be submitted with an official Purchase Order (P.O.).
  • No handwritten or verbal orders will be accepted.
  • Quotations are valid for 7 days, subject to stock availability.
  • An official Tax Invoice will be issued upon receipt of a valid P.O.

Payment Terms

  • PSO (Payment Secures Order): Full payment required before dispatch.
  • Credit Accounts: Payment due within 30 days from invoice month-end, unless agreed otherwise.
  • Mesmerize Lighting may require Personal Suretyship or Credit Liability Undertakings for accounts exceeding R50,000.
  • Late payments may incur interest and legal costs at the maximum rate allowed by law.

Project & Large Orders

  • Project or made-to-order products require a 35% non-refundable deposit.
  • Orders exceeding R300,000 may not be cancelled once placed.
  • Lead times are estimates only and delays do not entitle cancellation or claims.

Delivery & Risk

Delivery is via approved couriers or collection from:

  • Durban: Unit F3, Tradepark, 54 Siphosethu Rd, Mount Edgecombe
  • Port Elizabeth: Unit 26–28, Federated Park, 26 Paterson Rd, North End

Delivery fees:

  • Free delivery for orders over R6,000 (excl. VAT)
  • Otherwise R350 delivery fee

Risk passes to the Client upon delivery or collection.

Inspection & Claims

  • Deliveries must be checked immediately.
  • Any damage, shortages, or errors must be reported within 24 hours in writing with photographs.
  • Claims received after 24 hours will not be accepted.

Ownership

Ownership of Products remains with Mesmerize Lighting until full payment is received.

Liability

Our liability is limited to repair, replacement, or refund of defective Products, at our discretion.

Governing Law

These terms are governed by the laws of the Republic of South Africa
